A real title search

Every MoXi transaction includes a legal title search through the Public Registry covering the prior ten years. It confirms the seller has the right to sell and that no liens or encumbrances are recorded against the property.

Title insurance

Title insurance is required on every MoXi transaction. Many foreign buyers paying cash skip it. It protects you if a claim surfaces years later, which is the moment it matters most.

An independent appraisal

A professional appraisal establishes what the property is actually worth before you commit. Cash buyers frequently skip this step and find out later.

Fideicomiso setup handled

If your property sits in the restricted zone, you'll hold it through a bank trust. MoXi coordinates the setup as part of the loan, and monitors the renewal annually as part of servicing.

Yes. No law prohibits a foreign national from owning residential property in Mexico. Inside the restricted zone, which covers land within 50 kilometers of the coast or 100 kilometers of a border, you hold the property through a fideicomiso, a Mexican bank trust. Outside that zone you can hold title directly. Either way you have the right to use, occupy, improve, lease, sell, and pass the property to your heirs.
Yes. MoXi lends to U.S. citizens and to permanent residents of the United States, meaning lawful permanent residents who hold a green card. This is different from Mexican permanent residency (residente permanente), which does not by itself make you eligible. If you hold a green card and are buying residential property in Mexico, you apply on the same terms as a U.S. citizen.
MoXi offers purchase loans from approximately $200,000 to $2.5 million USD on residential property in Mexico valued at approximately $350,000 or above. Financing goes up to 65% of the appraised value, which means a minimum down payment of 35%. On a property appraised at $1,000,000, the maximum loan is $650,000 and you would bring $350,000.

Our underwriting team reviews your documentation, verifies the details of your scenario, and commits to financing terms subject to property appraisal and title work. That carries real weight with a seller, and it tells you what you can actually finance before you start negotiating. Timing depends on how complete your documentation is and how complex your scenario is. Your advisor will give you a specific timeline.
A fideicomiso is a Mexican bank trust that lets non-Mexican citizens hold residential property in the restricted zone. The bank is the trustee and takes instruction only from you, the beneficiary. The property is not an asset of the bank. If the trustee bank were to face financial difficulty, the property transfers to another trustee bank under Mexican federal law. The initial term is 50 years and renews indefinitely in 50-year terms. MoXi selects its partner trustee institutions carefully and monitors your renewal annually as part of loan servicing.
No. You hold a contractual right with the trustee bank to all benefits from the use or sale of the property, and the bank has a fiduciary obligation under Mexican law to respect that. You have a contractual right to renew for another 50-year term at expiration, and you can request extensions repeatedly without issue.
Every legal property transfer in Mexico must be overseen by a notario público. The notario reviews and executes the required documents, confirms all legal formalities have been satisfied under Mexican law, and collects and forwards transaction taxes to the Mexican tax authorities. Be cautious of any seller who suggests a closing that doesn't involve one.

Yes. Title insurance is required on every MoXi loan. It is not optional and it is not conditional on your loan amount or your property value, and we'd recommend it whether or not you finance with us.

The title search looks at what the public record shows. Title insurance covers what the record did not reveal, such as a competing ownership claim, a recording error, a forged instrument earlier in the chain, or an heir nobody knew about. Policies are issued only after a full title search, and the premium varies with the coverage amount, which tracks your property value. Budget for it as part of your cash to close. Your advisor will walk you through how it applies to your specific property.

There is no single figure, and a percentage quoted without a price attached to it tells you very little. Closing costs are a list of individual charges rather than a rate. Many of them are fixed dollar amounts that do not change with the price of the property, and only a handful scale with the transaction, so the same set of charges produces a very different percentage on a lower-priced purchase than on a higher-priced one.

Location matters too, because the acquisition tax and registry fees are set at the state and municipal level, and so does the property's title history, which determines how much diligence work the file takes. The largest single items in most transactions are the acquisition tax and the notario honorarios, and both are third-party charges a cash buyer pays as well.

The buyer pays most of the schedule. The seller typically covers any capital gains tax due and broker commissions out of proceeds. The reliable way to know your number is to run the schedule against a specific property, purchase price, and loan amount. MoXi reports mortgage interest paid in the United States, which may make it deductible on your federal return depending on your situation. Because of the treaty between the United States and Mexico against double taxation, you may also be eligible for U.S. tax credits on taxes paid in Mexico. Speak with your CPA or tax advisor about your specific circumstances.
MoXi finances completed, habitable residential property: condos, single family residences, 2 to 4 unit residential properties, and occasionally mixed use where 50% or more of the air-conditioned square footage is residential. Owner occupied, second home, vacation home, and investment property are all eligible occupancy types. Raw land and ground-up construction are not currently in our program.
You can hold your rights in your individual name, a U.S.-based revocable trust, an LLC, or a corporation. MoXi's in-house and external legal teams work with you to decide what fits. If you vest in an entity, we may ask you to obtain an apostille, which authenticates U.S. documents for use in Mexico, and we work with a vendor approved for all 50 states. As for selling, anyone can buy your property at any time with no restriction tied to your MoXi loan. Just as in the United States, the mortgage is paid off prior to or concurrent with closing.
Yes. MoXi offers cash-out refinancing to existing owners up to 60% of appraised value, with no restrictions on how you use the proceeds. Any existing lien is paid off at closing with the new loan proceeds. You can read more on our refinance page.
